OFFICAL RULES AND REGULATIONS 1. ELIGIBILITY The "Gay Operation Ass Cash" Sweepstakes is currently offered only in the United States and its territories to legal United States residents at least 18 years old. Employees and directors of Zooass Enterprises, Inc., their parents, affiliated and subsidiary companies and the immediate family or members of their same households of such employees and directors are not eligible. By entering, you agree to these Official Rules and the decisions of Zooass Enterprises, Inc., the "Gay Operation Ass Cash" Sweepstakes judging organization, which are final and binding in all respects. 2. PROMOTIONAL PERIOD The "Gay Operation Ass Cash" Sweepstakes begins on December 1, 2002, at 10:00 p.m. Eastern Time (ET), and ends on March 1, 2002, at 11:59:59 p.m. ET. At the end of the Promotional Period there will be a prize drawing. 3. ENTRY On-line Method of Entry: Play the "Gay Operation Ass Cash" Sweepstakes game at http://www.zooass.com/games/gayoperation/sweepstakes. Once you beat the game an entry form will appear. Fill in your full name, complete home address, home telephone number (including area code), e-mail address and date of birth. You must be at least 18 years of age to enter the "Gay Operation Ass Cash" Sweepstakes. Any other attempt at Internet or e-mail entry outside of the game located at http://www.zooass.com/games/gayoperation/sweepstakes is void. Mail-in Method of Entry: To enter by mail, on a 3"x5" card in black or blue ink hand print your full name, complete home address including zip code, home telephone number with area code, date of birth, e-mail address (if available), and your home phone number (including area code) and mail in a first class stamped envelope to: Zooass Enterprises, Inc., PO Box 1058, Herndon, VA 20172. Limit 1 card per person per day. Entries must be postmarked and received by the day prior to the prize drawing. No participant may enter more than once per day. No responsibility is assumed for lost, late, incomplete, stolen, misdirected, illegible or postage due entries, e-mail or mail; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. 4. DRAWING The winner for the "Gay Operation Ass Cash" Sweepstakes will be selected by random drawing from all eligible entries received for that drawing. The winner will be notified by e-mail, telephone, or mail within approximately 7 days of the drawing. Drawing for the Grand Prize will take place on or about 10/01/01. Drawings will be conducted under the supervision of Zooass Enterprises, Inc. 5. PRIZE/ODDS (1) Grand Prize: There will be one prize awarded for the entire Promotional Period : The winner shall be selected by random drawing from all eligible entries received during the Promotional Period. The Grand Prize winner will receive a $100 gift certificate to Amazon.com (Amazon.com in no way endorses Zooass Enterprises, Inc.) via e-mail, good for $100 worth of merchandise ordered on-line. Odds of winning depend on the number of eligible entries received. No assignment, transfer or substitution of prize is permitted. All prizes are expressed in U.S. Dollars. Taxes are the sole responsibility of winner. 6. GENERAL CONDITIONS The winner must execute and return a signed Affidavit of Eligibility as confirmation of identity and age within 2 weeks of notification. Failure to return this document within 2 weeks, or if prize notification or prize is returned as non-deliverable, or if winner is found not to be in compliance with these Official Rules, or otherwise ineligible, disqualification may result with an alternate winner selected. By accepting a prize the winner grants permission for Zooass Enterprises, Inc. to post his or her name, home town and state on the web site http://www.zooass.com. If the winner does not wish his or her name to appear on http://www.zooass.com, they may supply a fictitious pseudonym that will be displayed in place of his or her real name. Further, by accepting a prize, the winner releases and agrees to hold harmless Zooass Enterprises, Inc., and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Sweepstakes related activity, or participation in the "Gay Operation Ass Cash" Sweepstakes. Void where prohibited. Zooass Enterprises, Inc. reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site; to be in violation of the Terms of Service of the web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons using any such methods will be disqualified. Sponsor will prosecute any fraudulent activities to the full extent of the law. 7. LIMITATIONS OF LIABILITY Zooass Enterprises, Inc. is not responsible for any incorrect or inaccurate information, whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized in the "Gay Operation Ass Cash" Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes for any drawing(s) and select the winner from entries received for that drawing prior to the action taken or in such other manner as Sponsor deems fair and equitable. DISPUTES As a condition of participating in the "Gay Operation Ass Cash" Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased. 9.
